These General Terms and Conditions govern the relationship between Megality Ltd. (hereinafter the “Seller”) and customers (hereinafter the “Buyer(s)”).
1. The General Terms
The Buyer is obliged to get acquainted with General Terms and Conditions of Sale before ordering any goods Megality Ltd.
The Seller
Megality Ltd, INN (Taxpayer Identification Number) 6319231363, with its seat in 112 Young Pioneers, apt.15, Samara, 443035, Russia. CEO Koryashkin Konstantin.
The Buyer
The Buyer is End User or Businessman.
2. Confidentiality and protection of information
Seller declares that all personal data are confidential and will only be used for the execution of the contract with the Buyer and these data will not be made public or or provided to third parties with the exception of data needed for transportation of the goods or the method of payment concerning the goods ordered.
The seller has the right through reposts to distribute advertising of goods purchased by the buye
3. Order processing
3.1. All orders are considered binding.
3.2. The Seller is entitled to change this price in view of actual situation on the market and depending on the foreign currency exchange rate development.
3.3. We recommend the Buyer to reported accurate and truthful information to the order form. The Seller will confirm the order by e-mail message, in which you have the last chance to check the accuracy of the completed data. If you find any mistakes contact us immediately.
3.4. If the prices of the goods are changed during the processing and sending, Buyer will get the goods for the price valid in made order.
3.5. Seller reserves the right contact the Buyer by phone or email to verify or clarify the order, in case of a higher order value, any missing or inaccurate data, etc.
4. Payment Terms
Paypal account number is sent by e-mail to the Buyer with the price of postage and packing according to the applicable fare transport services, after approval period of manufacturing.
Variable symbol is identical to the ID of your order, you receive the confirmation e-mail. Paid goods will be prepared and on the specified date sent.
Goods remain the property until full payment of the seller.
5. Terms of delivery
Personal pickup:
Goods can be collected only by a person, who must sufficiently identify himself with a valid identity card or with a valid passport.
Delivery through a shipping company:
Goods can be send to the Buyer by a shipping company Post of Russia. Seller reserves the right to grant an extension in special cases arising from force majeure or in cases where no objective reasons can be made in the expected delivery time. In this case, the customer will be notified. Seller reserves the right to refuse an order in case of speculative nonstandard composition or quantity.
1. Place of delivery is the address, which the Buyer states in the order form (shipping address).
2. Part of the order goods is the invoice – further on referred as warranty certificate.
Before accepting the shipment from the forwarder the Buyer is obliged to check the state and condition of shipment (number of packages, damage of box) as per the accompanying delivery note and to refuse to accept incomplete or damaged shipment. Damaged or incomplete shipment must be reported without any delay to e-mail address [email protected]. Damage Protocol has to be signed with the forwarder and sent e-mail to the Seller. If the Buyer accepts the shipment by signing the documents of the forwarder, he has no right to make a subsequent warranty claim on the damaged or incomplete shipment.
6. Withdrawal from the Contract
According to Act No. 367/2000 of 14th September 2000, the Buyer has the right to withdraw from the contract within 14 days from the date of delivery provided he did not order the goods personally and it were delivered via forwarder. If the Buyer decides to withdraw from the contract within this time limit, he must meet the conditions listed below:
Goods sent and delivered on the Sellers address must be in original packaging, undamaged, complete(including accessories, warranty certificate, manual, etc.) and with a copy of the bill of sale. Do not send goods on cash collection delivery basis – it will not be accepted. We recommend you to insure the goods. If any of the above conditions are not adhered to, the Seller has the right to reject the returned goods or reduce the value for which the goods will be accepted back. If all the above conditions for returning of goods are met your money for the goods will be send by a bank transfer on your account in 30 days after the goods have been received by Megality at the latest.
7. Warranty
Any claims are governed by applicable law.
7.1. General Provisions
By accepting goods from the Seller, the Buyer agrees with the Warranty Claim Policy outlined below. Should the goods not be taken over by the Buyer personally, the handover of goods shall be understood as the moment the goods are handed over to the carrier.
As a document of warranty (warranty certificate), company Megaliths Ltd. will issue for each item purchased a bill of sale (invoice – further on referred as warranty certificate) containing all necessary data for submission of a warranty claim (item description, unit price, number of items…).
7.2. Warranty period
The legal warranty period is generally 6 months for all goods, unless the goods stated. The warranty period begins when the Buyer takes delivery of the goods, i.e., on the day listed on the warranty certificate. Product lifetime is 20 years.
7.3. Terms of warranty
a) We recommend the Buyer to check the condition of goods (consignment) right before accepting it from forwarder (number of packages, damage of box) and to reject the taking over of the damaged consignment. Eventual damage or incompleteness of the consignment caused by the forwarder needs to be settled with the forwarder and not with the seller. If the Buyer accepts the packaging showing obvious damage or incompleteness from the carrier and confirms that by signing the delivery note then it is not possible to additionally make a warranty claim.
b) We recommend the buyer to inform the seller about eventual damage or incompleteness on [email protected] as soon as possible. If the Buyer accepts the packaging showing obvious damage or incompleteness from the carrier and confirms that by signing the delivery note then it is not possible to additionally make a warranty claim. The Buyer is entitled to submit the warranty claim to the seller only for faulty goods which were purchased from the Seller. Claim has to be raised before the expiration of the warranty period.(see warranty certificate – bill of sale).
c) Warranty claim is to be placed at Megality Ltd. 112 Young Pioneers, apt.15, Samara, 443035, Russia.
d) In case of waranty claim the defective goods may be sent to the seller’s seat by mail or via forwarder. The package must be visibly marked “REKLAMACE” and should contain: the goods being claimed (including all accessories), a copy of the bill of sale, a detailed description of the defect, and sufficient contact information for the Buyer (return address, telephone number). Goods sent at the expense of the Seller will not be accepted!
e) The Buyer has to prove the validity of warranty by submitting the bill of sale, and if the goods have been previously claimed under warranty, he must also submit that previous warranty claim.
f) The warranty does not apply to defects caused by:
- mechanical damage to the goods
- mechanical damage to the goods during the transfer (see above)
- inexpert installation, handling or service (use) in contravention of the conditions listed in the documentation or of general principles (if the documentation of these goods exists)
- use of the goods under conditions which do not correspond to the parameters and requirements listed in the documentation (if the documentation of these goods exists)
- damage to the goods through excessive load, overuse or use in contravention of the conditions listed in the documentation or of general principles
- goods modified by the customer (painted, bent, etc.)
- damage to the goods by natural elements or force majeure
7.4. Warranty claims processing
We recommend to inform us about claims of goods by telephone or e-mail as soon as possible.
The defective goods may be sent to our seat by via forwarder as a recommended package.
The package should contain the goods being claimed (including all accessories), a detailed description of the defect, a copy of the bill of sale, and sufficient contact information for the Buyer (return address, telephone number).
The warranty claim will be processed by the Seller without unnecessary delay and within maximum of 30 days from the date the Buyer submits the warranty claim.
8. Limitation of Liability
To the extent not prohibited by law, in no event shall Megality Ltd. be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, business interruption or any other commercial damages or losses, arising out of related to your use or inability to use the climbing volumes Megality Ltd.
9. Final provisions
These General Terms and Conditions are effective and supersede all previous provisions and practices. The Seller reserves the right to change these General Terms and Conditions without previous notice.
